Sabinsa Corporation announced today that it has notified Alchem International as to the status of its patent covering the use of Forskohlin (ForsLean®), and has demanded that Alchem cease any activities that mislead the public.
Sabinsa Corporation and Sami Labs Ltd. ("Sabinsa") co-own U.S. Patent No. 5,804,596, directed to uses of forskohlin. In order to further strengthen the '596 patent, Sabinsa filed a Request for Reexamination with the U.S. Patent and Trademark Office on December 1, 2004, which was ultimately granted. The case is currently on appeal to the Court of Appeals for the Federal Circuit. Pending final disposition of the case, the '596 patent has not been declared invalid by the PTO. Sabinsa has notified Alchem that any statements to the contrary are misleading.
